Welcome to SWIP

These Terms of Service ("Terms") govern your use of the SWIP Dashboard platform. By accessing or using our Service, you agree to be bound by these Terms.

1. Service Description

What is SWIP?

SWIP (Smart Wellness Intelligence Protocol) is a wellness intelligence platform that:

  • Tracks Biometric Data: HRV, heart rate, and stress metrics
  • Calculates Wellness Scores: Real-time SWIP scores (0-100)
  • Provides Developer Tools: API access for wellness app integration
  • Offers Transparent Rankings: Global leaderboard for wellness apps

Service Availability

  • We strive for 99.9% uptime
  • Scheduled maintenance announced 24 hours in advance
  • Emergency maintenance may occur without notice

2. User Accounts

Account Registration

To use the developer features, you must:

  • Provide accurate information (name, email)
  • Be at least 18 years of age
  • Maintain one account per person
  • Keep credentials secure

Account Security

You are responsible for:

  • Maintaining confidentiality of login credentials
  • All activities under your account
  • Notifying us of unauthorized access
  • Keeping account information current

3. Developer Portal

App Registration

When you register an app:

  • You retain ownership of your app
  • You grant us license to display app data on leaderboards
  • App names must be unique and not infringe on trademarks
  • Apps must comply with our acceptable use policy

API Keys

  • API keys are confidential and non-transferable
  • You are responsible for key security
  • Compromised keys should be revoked immediately
  • Rate limits apply to prevent abuse

API Usage Terms

  • Rate Limits: 60 requests/minute for ingestion
  • Data Quality: You must send accurate, non-falsified data
  • Compliance: Follow our API schema and best practices
  • Monitoring: We may monitor for abuse or unusual patterns

4. Acceptable Use Policy

You May:

✅ Register wellness applications
✅ Send biometric session data via API
✅ View leaderboards and analytics
✅ Export your own app data
✅ Use for commercial wellness apps

You May Not:

❌ Send falsified or manipulated data
❌ Attempt to game rankings or scores
❌ Abuse API rate limits
❌ Access other users' private data
❌ Reverse engineer our scoring algorithms
❌ Use for illegal or harmful purposes
❌ Share API keys publicly

5. Data & Privacy

Your Data Rights

  • Ownership: You own your data
  • Access: View and export data anytime
  • Deletion: Request account and data deletion
  • Portability: Export in machine-readable format

Our Data Usage

We use your data to:

  • Calculate SWIP scores
  • Display on leaderboards (anonymized)
  • Improve our algorithms
  • Provide analytics insights

6. Intellectual Property

Our Rights

  • The SWIP platform, algorithms, and branding are our property
  • You may not copy, reverse engineer, or redistribute our code
  • SWIP™ and related marks are our trademarks

Your Rights

  • Your session data remains yours
  • You grant us non-exclusive license to process and display data

7. Payment & Billing

Current Service

SWIP Dashboard is currently free for developers.

Future Pricing

  • We may introduce paid tiers in the future
  • 90 days notice before charging existing users
  • Grandfather existing users at discounted rates
  • No surprise charges

8. Limitation of Liability

Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.

Liability Limits

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:

  • Indirect, incidental, or consequential damages
  • Loss of data, revenue, or business
  • Service interruptions or downtime
  • Third-party actions or integrations

Maximum Liability: Amount paid for the Service (currently $0)

9. Termination

By You

  • Delete your account anytime
  • Data removed within 30 days
  • API keys immediately deactivated

By Us

We may terminate accounts for:

  • Violation of these Terms
  • Fraudulent activity
  • Abuse of service or API
  • Non-payment (if applicable)

Notice: 7 days for minor violations, immediate for serious violations

10. Changes to Terms

Updates

  • We may update Terms with 30 days notice
  • Notice via email and dashboard banner
  • Continued use = acceptance
  • Disagree? Delete account before effective date

11. Dispute Resolution

Governing Law

These Terms are governed by the laws of California, United States.

Resolution Process

  1. Informal Resolution: Contact us first (legal@swip.synheart.io)
  2. Mediation: Good-faith mediation if needed
  3. Arbitration: Binding arbitration for unresolved disputes
  4. Class Action Waiver: Individual claims only
